White House Photographer Offers a 'Front Row Seat' to the Presidency

This week, our Sunday Spotlight shines on Eric Draper, who documented eight years of history as the chief White House photographer for President George W. Bush.

With unparalleled access to the president, Draper captured the full scope of Bush's time in office - from the intensity of 9/11 and visits with wounded veterans, to quiet moments on his family ranch in Crawford, Texas, or praying with the family of Dr. Martin Luther King, Jr.

"My job was not to be a distraction. My job was to purely document," Draper told ABC News. "That was a very unique role in the White House ? to have that much access to the president ? and not to be a participant in the meetings, but to be an observer."

Draper selected from nearly four million images for his new book, " Front Row Seat: A Photographic Portrait of the Presidency of George W. Bush."

"The cover of the book has an image of the president outside the Oval Office, walking through the colonnade," Draper said. "There's definitely some intensity in his expression. There's something thoughtful going on at that moment."

"This was a moment in between meetings early in the morning, and the light just was perfect. And I just had to go out and follow him. Typically, I would try to kind of gauge when I would kind of intrude on his personal time, and he went out for a breather, but the light was just too beautiful. And I had to go out and make the picture. And he walked by me without even looking at me."

"The president and the First Lady are sitting on this very large couch in Buckingham Palace. And what's neat about Buckingham Palace is that it's just like the White House, except everything's bigger," Draper said.

"They were like kids, they were having fun," he said. "They were guests of the Queen, and they're about to leave for a black-tie dinner that night. So they were walking around, and they were like, 'Oh, Eric, come over and take our picture on this couch.' And so it made for a fun moment."

"One day in the Oval Office - I believe this was in 2002 - a box arrived, and it was a gift," Draper said. "This is early in the morning, no one else is around. He opens the box and he pulls out this boxing robe ? and on the back, it had his name, 'George W. Bush.'"

"Of course he tries it on. And he's looking around for someone to show it to," Draper said. "In that image, he's opening the Oval Office door looking through the hallway to see if anyone's walking around, because he really wanted to show it off ? A lot of those moments I had to wait, just hang out and wait, and luckily I was there to capture that funny moment."

We've seen a few stabs at smartphone-enhanced car diagnostics as of late, but many good solutions like Automatic Link and Delphi's Vehicle Diagnostics are primarily useful after you've parked. The upcoming Dash OBD-II adapter is certainly up to that side of the job, telling a Bluetooth-connected iOS device (and eventually, Android) about your car's problems and estimating fuel costs based on the gas tank's levels. Where it stands out is its usefulness while on the road: the custom app offers custom live gauges, including a Green-Meter for ideal fuel economy that you won't usually find in a real instrument cluster. There's even a dashcam mode that overlays travel details on captured video, whether it's to support insurance claims or just to immortalize a drive through the back country.

If the Dash approach sounds intriguing, you'll be glad to hear that the contribution tiers are simple. Drivers who want their own Dash can pledge $69 if they live in the US, or $20 more if they're in Canada; adding another $51 to either pledge bundles a second model for two-car households. Both the mobile app and a web-based logging service will be free. Those who donate should get their units in October if Dash makes its $750,000 goal, although eager adopters willing to spend $150 on a beta tester's tier should get a not-quite-finished example in July.     There is no property to set the back color of Datetime Picker, is there another way to set backcolor of it?

    It's a VERY weird thing... supposedly, you can use .CalendarMonthBackground or .CalendarTitleBackColor, but I can't get it to work. The properties are in the property list, they're in the docs too, but it doesn't seem to work at all.

    Yes, weird. It seems that MS in their wisdom haven't filled in these properties (excuse the silly pun! groan).

    There is code here at SO to achieve this, but it is in C# and needs translation; but it requires creating a custom control that extends DateTimePicker.

    Doesn't solve your problem but it explains why those properties seem to have no affect. Unless you want everything to have that old ugly Win 98 look and feel :(

    In breaking news, the Government Accountability Office has issued a report critical of the definitions states are allowed to use in determining whether racial or ethnic groups are overrepresented in special education. It has long been the contention of certain racial and?ethnic?groups?that their kids are included in special ed in ?disproportionate numbers.

    In 2010, states required about 2 percent of all districts to use Individuals with Disabilities Education Act (IDEA) funds for early intervening services to address the overrepresentation of racial and ethnic groups in special education. Based on definitions states individually developed to measure this overrepresentation-- referred to in IDEA as significant disproportionality--356 districts were required to provide services. Half of these districts were clustered in five states and 73 were in Louisiana alone. States have used flexibility provided by Education to develop their own definitions of significant disproportionality and GAO's analysis of 16 selected states found wide variation in definitions. Further, GAO found that the way some states defined overrepresentation made it unlikely that any districts would be identified and thus required to provide early intervening services. Nebraska and Louisiana illustrate differing outcomes that can result from different state definitions. In Nebraska, one of 21 states that did not require any districts to provide services in 2010-11, racial and ethnic groups must be identified for special education at a rate three times higher than for other groups for 2 consecutive years. In contrast, racial and ethnic groups in Louisiana districts must be identified for special education at twice the rate of other students in any year. GAO's analysis found if Nebraska had used Louisiana's definition, Nebraska districts may have been required to provide services and, conversely, Louisiana might have identified fewer districts under Nebraska's definition.

    Rogue Dentist May Have Exposed 7,000 Patients to HIV, Hepatitis

    The Tulsa Health Department is warning 7,000 patients of a local dentist's office that they could have contracted HIV, hepatitis B or hepatitis C from poor sterilization practices.

    Dr. Wayne Harrington, an oral surgeon with a practice in Tulsa, Okla., is being investigated by the state dental board, the state bureau of narcotics and the federal Drug Enforcement Agency because one of his patients recently tested positive for hepatitis C and HIV without known risk factors other than receiving dental treatment.

    Upon hearing of the infected patient, the Oklahoma Board of Dentistry conducted a surprise inspection of Harrington's practice on March 18, allegedly finding numerous problems, including regular use of a rusty set of instruments on patients with known infections, and the practice of pouring bleach on wounds until they "turned white."

    Calls to Harrington's office were directed to an operator, who told ABC News the clinic no longer took voicemails. The operator said patients were being referred to another clinic, but did not disclose the clinic's name.

    Susan Rogers, executive director of Oklahoma's Board of Dentistry, called the incident a "perfect storm." On top of his many violations in sanitary practice, the dentist was a Medicaid provider, which means he had a high proportion of patients with HIV or hepatitis, she said.

    Harrington and his staff told investigators that he treated a "high population of known infectious disease carrier patients," according to a complaint filed by the Oklahoma Board of Dentistry.

    He allegedly allowed unlicensed dental assistants to administer medication, according to the complaint. These assistants were left to decide which medications to administer, and how much was appropriate.

    Drug cabinets were unlocked and unsupervised during the day, and Harrington did not keep an inventory log of drugs, some of which were controlled substances. One drug vial expired in 1993.

    "During the inspections, Dr. Harrington referred to his staff regarding all sterilization and drug procedures in his office," the complaint read. "He advised, 'They take care of that. I don't.'"

    Harrington allegedly re-used needles, contaminating drugs with potentially harmful bacteria and trace amounts of other drugs, according to the complaint. Although patient-specific drug records indicated that they were using morphine in 2012, no morphine had been ordered since 2009.

    The instruments for infected patients was given an extra dip in bleach in addition to normal cleaning methods, but they had red-brown rust spots, indicating that they were "porous and cannot be properly sterilized," according to the complaint.

    The Tulsa Health Department said Harrington's patients will receive letters by mail notifying them of the risk and steps to obtain free-of-charge testing.

    While 7,000 patients may have been exposed, Joseph Perz, an epidemiologist with the U.S. Centers for Disease Control and Prevention, said it's "extremely rare" to see dental transmission of HIV and hepatitis B or C. In July 2012, 8,000 Coloradans were notified that their dentist had reused needles, potentially exposing them to the blood-borne viruses. But not a single case was identified, according to the CDC.

    Dental transmission is not impossible, however. Perz cited a dental fair three years ago in which hepatitis B was transmitted between patients.

    In July 2012, more than 1,800 veterans who received dental care at a St. Louis VA Medical Center were warned that improper cleaning of dental tools may have exposed them to HIV and hepatitis.

    The Tulsa Health Department has set up a hotline at (918) 595-4500 for people with questions.

    When owners and teams treat football like a business, media and fans shrug.? When players do, it?s regarded as an affront to the integrity of the game.

    It?s not fair, but that?s the way it is.? And Raiders quarterback Carson Palmer needs to brace himself for that reaction as he tries to force his way out of Oakland.

    It?s obvious Palmer wants out.? Two years ago, he finagled his exit from Cincinnati by feigning retirement.? The strategy looked to be a failure until Raiders quarterback Jason Campbell broke his collarbone and former Raiders coach Hue Jackson lost his damn mind, giving up a first-round pick and a second-round pick for a quarterback who isn?t the guy he used to be.

    Now, Palmer is turning up his nose at $10 million from the Raiders, which sets the stage for the Raiders eventually to cut him ? and for Palmer to play for someone else.

    As Mike Silver of Yahoo! Sports explains it, Palmer wants to play for a contender, even if it means being a backup.? (Cough . . . Seahawks and Pete Carroll . . . cough.)? Of course, Palmer won?t get $10 million to be a backup, but his willingness to walk away from football in order to get out of Cincinnati proves that he?d be willing to walk away from $10 million in order to get a shot at winning.

    Palmer?s posture also reflects a belief that, despite the hiring of G.M. Reggie McKenzie and coach Dennis Allen, Palmer doesn?t see the silver-and-black bus getting turned around in the immediate future.? Otherwise, he?d gladly take $10 million to stay put.

    The problem is that the Raiders currently hold all the cards.? With no seven-figure trigger in Palmer?s deal, the $13 million doesn?t become fully guaranteed until Week One, which means the Raiders can cut him much later in the offseason, if they draft a quarterback early ? or if they eventually decide Terrelle Pryor can get the job done.? The only risk the Raiders are taking is that, if Palmer drops a dumbbell on his foot or pops an Achilles tendon in offseason conditioning drills or otherwise suffers a season-ending injury while on the clock, the Raiders will owe Palmer his full salary.

    That could set the stage for a Steve McNair-style lockout.? Even without Palmer being barred from the building (which would violate the CBA), Palmer is making his second power play in two years.

    When a team does it, we applaud.? Fair or not, Palmer should prepare for the jeers and the boos and the accusations of being a chronic quitter.

    "You are Here" Method to Success - The Self Improvement Blog

    We all have dreams and aspirations. Some of us know exactly how to get there and have mapped out the path from a very early age. Others however, have a much harder time trying to find out how to get there. It is not the destination that seems so scary on a long journey, but rather the starting point and duration.

    I was walking around the Mall of America the other week on a date to a restaurant inside the mall. Looking as dapper as can be, I found myself a little lost in the great abyss that the Mall of America is. Anyone who has ever been in the mall can conquer, that it is one giant maze of pure capitalism. Reluctantly, I looked at the map stand that will both guide me to the restaurant and crush my masculinity for the night.

    Upon looking at the series of squares adorned with letters and numbers, I came across an event that I knew all too well. I had found my place of destination almost?immediately (no thanks to my off-kilter sense of direction) but was struggling to find the little blue dot that indicated where in the world I was. I spent nearly twice the amount of time looking for where I was in the mall, then where I actually wanted to go.

    Many times, we know exactly where we want to go, and exactly how to do it. But we forget to first take a hard look at where we are first.

    And we must do this in such a way that we not only look at what we have physically, but to look at ourselves intrinsically to evaluate what types of beliefs, values, and opinions we have before embarking on our journey to the end point.

    Before embarking on a specific mission, we tend to forget to properly assess how much we have physically. This would mean, before leaving for said destination, taking a deeper look into financials, as far as assets and liabilities and taking a look into how much living plus the journey or end point will cost them.

    This isn?t just a financial point either. One should also look into time as a means of currency. How much time do you have to put into this specific process? How much time does this and other obligations require? These forms of logical questions before beginning large, timely, expensive projects are essential to get a feel for how you will manage yourself during, and after the project is done.

    Take into consideration a gentleman that is considering leaving his job for other opportunities. This man does not simply throw everything from his desk the next time his manager sets something on his desk the wrong way, but rather, he silently looks for other opportunities, while accounting for pay differences, driving times, and bills he must pay before taking his glorious walk out of the company he dislikes.

    It provides a smooth road map for success when taking an advanced look at you and your situation.

    On the social-emotional side of matters, you must also take a deeper look introspectively. This process will aid you in finding out whether you as a person is fit for a given project. Does the project fit the values that you hold true? Will the project challenge you to adopt or learn about new values?

    ?When you glance at the type of emotional tole the task at hand will take on you, you can both minimize damage and maximize growth.

    For example, a student that is planning on studying abroad that does look at the type of emotional tole culture shock will have on them, will not only be better prepared to cope by having ready and familiar with it, but is better equipped to learn because they have less recovery time and a greater understanding of their situation.

    To finish the story of my date at the mall, once we got there, we decided that the line was far too long and we didn?t want to end up waiting that long to get a seat. We had to re-route our entire nights plans based on the fact that this place was so busy and we had no chance of getting in within the hour.

    But luckily we found a restaurant near the one we had planned on going to with around the same type of menu that we both enjoyed. The process took a little bit of sitting around and discussing what the two of us wanted, didn?t want, could afford, etc. And that?s the beauty of the method, it?s never too late to look at where you are and to make adjustments to your original plan. It simply just takes a little time to think and access, and a carefully thought-out decision making process.

    To conclude, you will always?have a better idea of where you are going and have an easier time getting there, if you know where you are, how to get there, and where you?re coming from.

    Cypriot banks set to reopen after 12 days -- but customers can only withdraw $383 each

    Banks on the tax haven of Cyprus opened Thursday for the first time in 12 days amid the island's continuing financial crisis.

    Strict limits on the amount of money that could be withdrawn have been imposed ? people will be able to withdraw 300 euros ($383) a day and no checks will be cashed ? amid fears of a run on the banks.

    Account holders showed up hours before the banks were due to open to get in line.

    ?

    Early indications were that there was no mass rush to withdraw cash, with just 13 people waiting outside one large Bank of Cyprus branch on the island as it opened at noon local time (6 a.m. ET). They were surrounded by a scrum of journalists.

    Previously people could only withdraw 100 euros (about $127) a day from the country's two biggest banks from ATMs.?Most who lined up for the opening were elderly people and those without ATM cards.?

    However a small crowd of people did press against the doors of a branch of Laiki Bank, which is being liquidated. CNBC sources estimate those with more than 100,000 euros (about $128,000) in accounts in Laiki Bank could lose 40 to 70 percent of their deposits.

    Deposits above 100,000 euros with the Bank of Cyprus will be frozen and 40 percent of each account will be converted into bank stock. Accounts in both banks with balances under 100,000 euros will be fully protected.

    A previous proposal to take less from all bank accounts?was vetoed by the Cypriot parliament.

    The country is seeking to meet the terms of a bailout from the European Union of 10 billion euros ($12.9 billion) and, in order to raise enough funds to meet strict conditions imposed by the EU, it is preparing to take money from bank accounts.

    Ahead of the banks? reopening, money was flown into the island and guards were seen delivering cash to banks in armored vehicles.

    The banks were due to close at 6 p.m. local time (12 p.m. ET).

    There was some relief on the island that the banks were finally opening again, but this was mixed with fear about what could happen.

    The banks in Cyprus are set to reopen after days of being closed as a measure to prevent a run on deposits during the country's financial crisis. Millions in cash is on the move tonight as people camped out in expectation. ITV's Emma Murphy reports

    'Slow death'
    Yorgos Georgiou, who owns a dry cleaning business in Nicosia, told Reuters that "finally people's mood will be lifted and we can start to trust the system again."

    But he added: "I'm worried about the poor kids working in the cashiers today, because people might vent their anger at them. You can't predict how people will react after so many days."

    Kostas Nikolaou, a 60-year-old retiree, told Reuters that the uncertainty of the past two weeks had been "like a slow death."

    "How can they tell you that you can't access your own money in the bank? It's our money, we are entitled to it,? he added.

    The country?s president, Nicos Anastasiades, has described the bailout deal as ?painful? but essential.

    However, Nobel laureate economist Christopher Pissarides said it was ?extremely unfair to the little guy.?

    ?For the first time in the euro zone, depositors are (being) asked to bail out failing banks," he said. "Now that used to be the case in the 1930s, especially United States (and) caused big bank runs. It has been decided since then that we shouldn?t allow that to happen again.?

    As Cyprus celebrates its Independence Day, the ?government is defending the last-minute bailout deal it's negotiated with the European Union. This means shutting down the country's second biggest bank, with big savers facing ?losses. ?ITV's Emma Murphy reports.

    Among other controls, the island's central bank will review all commercial transactions over 5,000 euros and scrutinize transactions over 200,000 euros on an individual basis, Reuters reported. People leaving Cyprus can take only 1,000 euros with them. An earlier draft of the decree had put the figure at 3,000.

    Reuters summed up the situation facing the island:

    With just 860,000 people, Cyprus has about 68 billion euros in its banks - a vastly outsized financial system that attracted deposits from foreigners as an offshore haven but foundered after investments in neighboring Greece went sour.

    The European Union and International Monetary Fund concluded that Cyprus could not afford a rescue unless it imposed losses on depositors, seen as anathema in previous euro zone bailouts.?The bailout looks set to push Cyprus deeper into an economic slump, shrink the banking sector and cost thousands of jobs.

    European leaders said the bailout deal averted a chaotic national bankruptcy that might have forced Cyprus out of the euro.

    Many Cypriots say the deal was foisted upon them by Cyprus's partners in the 17-nation euro zone within the European Union, and some have taken to the streets to vent their frustration.

    Amazon acquires Goodreads, aims to make better recommendations for Kindle users

    So, Amazon has a reading platform called Kindle. Goodreads has a platform that makes fairly excellent suggestions when it comes to reading materials. You probably see where this is going. This evening, Amazon announced that it was acquiring one of the more popular reading recommendation engines, and while the outfit isn't making clear what it plans to do with the technology, it shouldn't take a scholar to see how it'd bolster Amazon's Kindle reader line as well as its array of Kindle apps. (What'll happen to Shelfari, however, is perhaps a bigger mystery.)

    Russ Grandinetti, Amazon's vice president of Kindle Content noted that "Goodreads has helped change how we discover and discuss books and, with Kindle, Amazon has helped expand reading around the world -- together, we intend to build many new ways to delight readers and authors alike." It's entirely likely that this will add another social angle to the Kindle framework, further establishing an ecosystem where friends could see suggestions based on what they're independently reading through their own Kindle accounts. The companies are expecting the deal to be finalized in Q2, which suggests that we'll see a proper integration just as back-to-school season begins. Right, guys?

    Moderate Sen. McCaskill supports gay marriage ? MSNBC

    Add Missouri Sen. Claire McCaskill to the growing list of politicians who have evolved on the issue of same-sex marriage.

    ?I have come to the conclusion that our government should not limit the right to marry based on who you love,? the moderate Democrat wrote on her Tumblr Sunday night. ?While churches should never be required to conduct marriages outside of their religious beliefs, neither should the government tell people who they have a right to marry.?

    As public opinion on gay marriage continues to shift toward record acceptance rates, more politicians have come out in support of it. In the last few weeks alone, former Secretary of State Hillary Clinton and her husband, former President Bill Clinton made public statements in support of repealing the federal rule that prevents gay marriage, the Defense of Marriage Act (DOMA). President Clinton signed the DOMA into law in 1996. Some Republicans, too, have broken with their party position this year by supporting gay marriage, including Sen. Rob Portman of Ohio. Dozens of Republicans signed a legal brief last month in support of gay marriage, including several ex-members of the George W. Bush administration.

    McCaskill?s support arrives the same week that the Supreme Court will hear challenges to the Defense of Marriage Act and California?s Proposition 8.

    The senator admits that her views on the subject ?have changed over time,? and says she can no longer stay silent on the issue: ?[A]s many of my gay and lesbian friends, colleagues and staff embrace long term committed relationships, I find myself unable to look them in the eye without honestly confronting this uncomfortable inequality. Supporting marriage equality for gay and lesbian couples is simply the right thing to do for our country, a country founded on the principals of liberty and equality.?

    In 2009, she came under fire after suggesting that a vote for a proposed gun provision would be like voting in favor of same-sex marriage, and last May, after President Obama came out in support of legalizing same-sex marriage, McCaskill refused to clearly state her own position. As noted by the?Springfield News-Leader, McCaskill has a history of walking a fine line when it came to supporting marriage equality for the LGBT community:

    McCaskill, D-Mo., has stated her opposition to gay marriage in the past, but she?s walked a bit of a tightrope on the question. She has expressed support for civil unions, which grant gay couples some ? but not all ? of the legal rights that married couples enjoy. She also opposed Missouri?s 2004 constitutional amendment banning gay marriage, arguing that it was unnecessary because existing state law already prohibited gay marriage.

    McCaskill defended her Senate seat in November against Tea Party backed Rep. Todd Akin after a contentious election battle. Akin?s comments on ?legitimate rape? and abortion became an oft-repeated soundbite against him last year.

    Same gun used in killing of Colorado prisons chief and Texas shootout, authorities say

    Evan Spencer Ebel died Thursday, March 21, in a shootout with police in Decatur, Texas.

    Colorado authorities said Monday that the same gun a white supremacist fired in a gunbattle with Texas police last week was also used in the shooting death of Colorado's prisons director.

    Texas police killed Evan Spencer Ebel, 28, after a high-speed chase Thursday through Decatur, Texas.

    He is also considered a suspect in the death of Tom Clements, executive director of the Colorado Department of Corrections, who was shot at his home near Denver last Tuesday, Colorado authorities say. He is believed to have shot and killed a pizza delivery man and used his uniform to get to Clements' front door without raising suspicion.

    Monday's ballistics report "goes well beyond" Texas officials' determination last week that shell casings at the scene of the shootout were from the same type of ammunition, the Colorado Springs Metro Crime lab said in a statement.

    Ebel had been paroled in January from a Colorado prison, and there is strong evidence to connect him to a white supremacist prison gang called the 211 Crew, which experts say demands that some of its members commit crimes once they leave prison.

    Sheriff?s deputy wrestles alligator away from middle school

    A Florida sheriff's deputy took matters into her own hands last week when a seven-foot alligator was spotted trying to break through the fence of a local middle school.

    Jessica McGregor, a 29-year-old Lake County sheriff's deputy and mother of two, responded to the call, fashioned a noose from a 30-foot rope and "lassoed the would-be intruder," the Orlando Sentinel reports.

    "I got him turned around, and he started to spin and flop and jump," McGregor told the paper. "Once he got tired, he just laid there and wiggled his tail. I threw the rope over him and dropped down with my knees behind his front legs. He jerked around a little bit and just gave up."

    The deputy, who said she and her brother used to catch alligators for fun, explained that she didn't want to wait the estimated two hours for the professional trapper to arrive.

    "I've lived in Lake County my whole life," McGregor told the paper. "Back in the day, you had these things come up on your land, and you just caught 'em up and threw 'em back in the nearest watering hole."

    No big deal.

    While alligator encounters are common in the state, attacks are less so and even then are rarely fatal. Still, they can be scary. Last summer, two Florida teenagers were attacked by alligators in a five-day span. One of them lost the bottom half of his right arm in the nearly fatal encounter.

    (AP) ? Democratic U.S. Sen. Tim Johnson of South Dakota plans to retire at the end of his term, Democratic officials said Monday ? a departure that gives Republicans a prime opportunity to pick up a seat as they attempt to win back control of the chamber in 2014.

    Johnson, the chairman of the Senate Banking Committee, suffered a brain hemorrhage in 2006 and later returned to the Senate and won re-election in 2008 while sometimes using a motorized scooter.

    The officials who described Johnson's plans spoke to The Associated Press on condition of anonymity, saying they were not authorized to pre-empt a formal announcement expected Tuesday in South Dakota.

    Johnson, 66, is the fifth Democrat to decide to step aside at the end of the term in 2014, joining Carl Levin of Michigan, Tom Harkin of Iowa, Jay Rockefeller of West Virginia and Frank Lautenberg of New Jersey. Two Republicans also have said they plan to retire, and the GOP must gain six seats to win a majority.

    Of the five states, South Dakota is seen as the most favorable to Republicans, who control the state's Legislature, governorship and other federal offices. Johnson was seen as competitive, despite the state's GOP tilt, in part because of his reserved manner and independent streak, as well as his committee chairmanship, which gives Johnson Senate clout as well as a robust fundraising base.

    Still, Democrats rejected the notion that Johnson's retirement opens the door for a GOP senator. In last November's election, some Republican Senate candidates who appeared to be the heavy favorites ended up losing to Democratic rivals ? including Rick Berg, who lost to Heidi Heitkamp in neighboring North Dakota.

    South Dakota Democratic Chairman Ben Nesselhuf noted Democrats' successes over the past 30 years, including former Senate Democratic Leader Tom Daschle.

    "I reject the idea that somehow the Republicans has a lock on this state," Nesselhuf said. "By no means is this an impossible task, or even improbable."

    Republican Mike Rounds, a popular former two-term governor, has announced his candidacy for the seat, and has been campaigning since last year. Rounds declined to comment on Johnson's retirement.

    Attempts by The Associated Press to reach Johnson through his top Senate staff were unsuccessful. Johnson aides would not confirm the retirement but said the senator would hold a news conference on his political future at University of South Dakota in Vermillion Tuesday afternoon.

    Aware that Johnson might decide to retire, Democrats in South Dakota and nationally have discussed possible successors on the ticket, including Johnson's son Brendan, South Dakota's U.S. attorney. The younger Johnson Monday said in an interview that he was unaware of his father's decision and declined to discuss whether he would seek the office.

    Former U.S. Rep. Stephanie Herseth Sandlin, a contemporary of Brendan Johnson and another heir to a South Dakota Democratic legacy, also is looking at running. A granddaughter of former South Dakota Gov. Ralph Herseth, Herseth Sandlin served six years in the U.S. House before being defeated for re-election in 2010.

    Action within Johnson's party is expected quickly. An open Senate seat is rare in South Dakota, and Republicans have gained an upper hand in the state, controlling the governorship, the Legislature, its other Senate seat and its lone U.S. House seat.

    Brendan Johnson, appointed U.S. attorney in 2009, has never held elected office and faced questions about his father's involvement in the confirmation process. Assets for the younger Johnson include his father's advisers and donor base.

    Herseth Sandlin also has an in-tact network and following in South Dakota, but she could face some problems in a potential primary with Johnson. She opposed to the 2010 Affordable Care Act, a position that is out of step with a majority of party loyalists.

    Republican Mike Rounds, a popular former two-term governor, has announced his candidacy for the seat, and has been campaigning since last year.

    Kaiser Permanente's Sad Mental Health Care in CaliforniaCalifornia has some patient-friendly regulations on its books, meant to help patients get the care they need in a reasonable amount of time. One of those regulations is that patients shouldn?t have to wait more than 10 business days for a regular appointment with their health or mental health care provider.

    Yet, Kaiser Permanente?s health maintenance organization in the state ? rather than abide by the regulation ? regularly made patients wanting mental health care wait longer than the 10 business days. In fact, in one case from 2010, the California Department of Managed Health Care (DMHC) fined Kaiser $75,000 for unreasonably delaying a child?s autism diagnosis for almost 11 months! The new report found that anywhere from 17 to 40 percent of patients waited longer than 14 days for an appointment.

    Last week, the DMHC was again at Kaiser?s doorstep, finding that Kaiser kept two sets of appointment records to try and circumvent this regulation ? a paper appointment calendar and an electronic health record calendar. The DMHC cited Kaiser for ?serious? deficiencies in how it manages and provides mental health care services to its patients.

    Kaiser Permanente is one of those enormous health care providers that seems to have lost the plot ? providing reasonable and timely health care for its customers.

    The latest Kaiser investigation by the DMHC was begun based upon a lengthy and detailed report (PDF) published in November 2011 by the National Union of Healthcare Workers ? which represents 2,000+ health care employees at Kaiser. In other words, this is Kaiser?s own staff blowing the whistle on the horrible clinical practices they were forced to implement for their patients.

    Here?s what the new DMHC report published last week concluded:

    • Kaiser committed ?systemic access deficiencies? by failing to provide its members with timely access to mental health services. Instead, large numbers of Kaiser?s patients were required to endure lengthy waits for appointments in violation of California?s ?timely access? regulations.
    • Kaiser?s internal record-keeping system contained numerous problems ? including a parallel set of ?paper? appointment records that differed from the HMO?s electronic records ? that hid patients? lengthy wait times from government inspectors.
    • Kaiser failed to adequately monitor and correct its violations of state law. Records show that Kaiser was aware of its violations, but failed to take action to correct the problems.
    • Kaiser provided ?inaccurate educational materials? to its members that had the effect of dissuading them from pursuing medically necessary care and violated state and federal mental health parity laws.

    This last point is particularly egregious because Kaiser ? in multiple materials across multiple provider sites ? suggested there were limits on mental health coverage visits. These limits haven?t been allowed ? by law ? since the federal mental health parity regulations went into effect in 2010. If you have a mental disorder diagnosis, your coverage is the same as it is for other health conditions. Yet in 2011, Kaiser was apparently still saying things like,

    If you read this, it may have dissuaded you from even seeking care, thinking your care would be arbitrarily limited by Kaiser (and not by what?s in your best treatment interests).

    Of course, Kaiser claims that since the beginning of 2012, it has worked on fixing these problems. How convenient? yet this isn?t the first time Kaiser has been fined by the DMHC, so let?s just say that I?m a little skeptical of their ?fixes.?

    ?The department feels these findings are really serious. Because of that, we are doing the immediate enforcement referral, which is unusual,? said Shelley Rouillard, chief deputy director of the Department of Managed Health Care.

    Kaiser, get your act together. It?s shameful that you treat patients with mental health concerns as second-class citizens in California, and you don?t listen to your own employees. Instead, they have to turn to the regulatory agency in order to have their concerns addressed. In my opinion, that demonstrates a business organization that is clearly broken.

    If you?re a patient of Kaiser?s HMO mental health system in California, I feel for you. The report linked above details practices that suggest Kaiser?s mental health patients are getting sub-standard care by overworked, underpaid, and unappreciated clinicians.
